As a customer of OG&E, you have an option to receive electronic delivery of paperless billing statements online through a secure OG&E website and to discontinue the delivery to you of billing statements on paper. If you elect to receive paperless billing statements pursuant to the Consent and Authorization for Electronic Delivery of Paperless Billing Statements on the OG&E website (the "Consent and Authorization"), a copy of which is set forth below as a part of this notice, you will not receive billing statements on paper while your election remains in effect. Instead, you will be notified electronically by e-mail each time a new billing statement or applicable account disclosure becomes available on the OG&E website for your viewing and downloading or printing.
You may revoke your election to stop delivery of billing statements on paper by giving notice to OG&E as provided in the Terms and Conditions of Electronic Delivery of Paperless Billing Statements (the "Terms and Conditions"), a copy of which is set forth below as a part of this notice. The delivery to you of paperless billing statements will be in all respects subject to and governed by the Terms and Conditions.
The OG&E website will be generally available to you 24 hours each day, 7 days each week. However, brief interruptions of availability may occasionally occur for website maintenance and reasons beyond our control.
If you want to receive paperless billing statements and stop delivery to you of billing statements on paper, you must affirmatively consent to and authorize those changes to your account preferences by completing and submitting the Consent and Authorization.
TERMS AND CONDITIONS OF ELECTRONIC DELIVERY OF PAPERLESS BILLING STATEMENTS
By clicking on the "Accept" button in the Consent and Authorization for Electronic Delivery of Paperless Billing Statements (the "Consent and Authorization") on the OG&E website, you acknowledge your understanding of and your agreement to the following terms and conditions:
PLEASE PRINT A COPY OF THESE TERMS AND CONDITIONS FOR YOUR RECORDS BEFORE COMPLETING AND SUBMITTING YOUR CONSENT AND AUTHORIZATION.
1. You agree to receive electronic delivery of all billing statements for your designated account with OG&E (the "Designated Account") and any disclosures that are required by applicable law or regulation to be delivered to you in writing with respect to such account. At its discretion, OG&E may deliver any disclosures by non-electronic means. If you have more than one account with OG&E, a separate Consent and Authorization must be completed and submitted by you with respect to each account for which you elect to receive electronic delivery of paperless billing statements and disclosures.
2. When you accept these Terms and Conditions of Electronic Delivery of Paperless Billing Statements (the "Terms and Conditions") by completing and submitting your Consent and Authorization, the account preferences relating to your Designated Account will be modified to provide for electronic delivery of paperless billing statements. Thereafter, so long as your Consent and Authorization remains in effect, you will not receive billing statements or disclosures for the Designated Account on paper through the mail.
3. Pursuant to your completed Consent and Authorization, OG&E will make all billing statements and applicable disclosures for the Designated Account available to you online through a secure OG&E website for your access at your convenience. Each billing statement and applicable disclosure pertaining to the Designated Account will be accessible for your viewing, downloading and/or printing for a period of ninety (90) days after the date on which the statement or disclosure is first made available to you.
4. Each time a new billing statement or applicable disclosure for the Designated Account becomes available online, OG&E will notify you electronically by an e-mail message sent to the e-mail address that you register with OG&E for such purpose. After the notification of each new billing statement or disclosure is sent to you by OG&E, it will be your responsibility and obligation to access and view each billing statement or disclosure in a timely manner that enables you to comply with required payment due dates, error resolution requirements, if applicable, and any other applicable terms and conditions of the Designated Account. If for any reason you cannot view, download or print a billing statement or disclosure after your receipt from OG&E of electronic notice of its availability online, it will be your responsibility and obligation to promptly contact and notify OG&E to make alternative arrangements for accessing such billing statement or disclosure in a manner that enables you to timely comply with required payment due dates and other obligations of the Designated Account.
5. You will not be charged a fee for electronic delivery of paperless billing statements and applicable disclosures pursuant to your Consent and Authorization; but, after the account preferences relating to the Designated Account have been modified to provide for electronic delivery of billing statements, and while your Consent and Authorization is in effect, OG&E reserves the right to charge a reasonable fee if you request delivery of a paper copy of any billing statement that has already been furnished to you electronically.
6. To receive electronic notification by e-mail that billing statements and applicable disclosures for the Designated Account are available online, you will need an active e-mail address that has been registered with OG&E for such purpose. Initial registration of your e-mail address will be required at or before the time you complete and submit your Consent and Authorization. If your e-mail address changes after being registered with OG&E, it will be your responsibility and obligation to promptly notify OG&E of the new e-mail address to which notices should be sent regarding the Designated Account. Your notification to OG&E should be provided by including the new e-mail address in your OG&E user profile at the OG&E website. You agree that OG&E will not be liable for any losses, damages or costs resulting from delivery of any notification to an inactive or invalid e-mail address furnished by you.
7. To obtain online access to your account and your paperless billing statements and applicable disclosures, you will need an Internet Service Provider (ISP) and a Web browser software program, such as version 6.0 or higher of Microsoft® Internet Explorer, that supports a security technology known as Secure Sockets Layer (SSL) and 128-bit encryption. You will also need version 9.1 or higher of the software program known as Adobe Acrobat Reader.
8. By completing and submitting your Consent and Authorization, you confirm that you have access to a computer satisfying the minimum hardware and software requirements necessary for you to view and download or print billing statements and applicable disclosures online, as such minimum requirements are described in the Consent and Authorization.
9. You understand and agree that OG&E has the right to determine at any time in its sole and absolute discretion whether any account or account holder, including your Designated Account, is eligible for use of the electronic delivery services provided pursuant to a Consent and Authorization. You also understand and agree that OG&E has the right to amend or supplement at any time and from time to time any provisions of these Terms and Conditions.
10. You understand and agree that OG&E has the right to terminate and cancel at any time in its sole and absolute discretion the electronic delivery services provided for any account or account holder pursuant to a Consent and Authorization, including your Designated Account. If electronic delivery services are terminated by OG&E with respect to any account, OG&E will make the necessary changes to such account to allow for delivery of billing statements and applicable disclosures on paper by mail or as otherwise provided under the original terms of the account.
11. Your ongoing consent to receive paperless billing statements and applicable disclosures electronically is voluntary. You may withdraw such consent at any time by unchecking the agreement to receive paperless bills in your user profile at the OG&E website.
12. You understand and agree that you must be an OG&E customer and have a currently active account to be eligible for the electronic delivery of billing statements pursuant to a Consent and Authorization.
13. You understand and agree that the password you select and use to access your Designated Account online should at all times be kept confidential; that you are responsible for the security of your password; that you are responsible for notifying OG&E about the loss or theft of your password; and that OG&E will not have any liability for losses, damages or costs resulting from a lost or stolen password. If you forget or want to change your password, it may be reset online.
14. You understand and agree that you are responsible for viewing your billing statement online, when available, and for paying your billing statement when due. You also understand and agree that late payment reminder notices may be sent to you either electronically by e-mail or in writing by mail.
15. You understand and agree that OG&E will not be liable for any losses, damages or costs resulting from any delays, interruptions or other failures in performance of these Terms and Conditions arising from any cause or circumstance beyond the reasonable control of OG&E.
16. You understand and agree that the agreement embodied by these Terms and Conditions may not be assigned or otherwise transferred by you and that any attempt to assign or transfer such agreement will be null and void. You also understand and agree that the said agreement will be governed and construed according to the laws of the State of Oklahoma, including, as appropriate, the Uniform Electronic Transactions Act, and according to applicable federal laws and regulations, including, as appropriate, the Electronic Signatures in Global and National Commerce Act.
